Terms of Service

Welcome to Sharpenters.com (the "website")! The policies, terms and conditions outlined herein apply to all users of this website (hereinafter defined as "customer", "user", "you" or "your"), which is owned and operated by Sharpenters 1965, LLC (hereinafter referred to as "Sharpenters", "we", "us" or "our"). By using any part of this website or by placing an order for the sharpening services of Sharpenters, you agree to be bound by these Terms of Service. The services, products and contents of this website, as well as these Terms of Service may change without prior announcement. It is the user’s responsibility to review these Terms of Service prior to placing an order for the sharpening services. Continued use of the website after changes made to the services, products, contents or Terms of Service constitutes acceptance by the user of such changes.

This website and our services are only available to those individuals who are 18 years of age or older and who live in the United States. If you are younger than 18 years old and/or live outside of the United States, please leave this website.

Disputes pertaining to this website and our services are determined by arbitration. Please see the arbitration and class action waiver provisions below.

  1. SERVICE DESCRIPTION

Sharpenters offers a sharpening service for knives and certain other household/commercial items. When purchasing the service, you may select a one-time sharpening or a subscription service. Once the service has been purchased, the user receives a specially manufactured envelope in which to submit the items for sharpening. If you choose to purchase the subscription service, Sharpenters will place periodic charges to your chosen method of payment and send the envelopes out at the frequency chosen at the time of purchase. If you choose not to send in your envelope when you receive it, you may use it at a later time without additional cost. However, payments made cannot be refunded and you will be charged and continue receiving envelopes throughout the time period originally ordered until such time as your membership terminates.

The need to sharpen an item depends on the material of the blade, how often it is being used and what it is being used for as well as the general maintenance of the item. Therefore, it is up to the user to decide upon the right frequency of sharpening or to just use the service one time.

When you sign up for our subscription service, Sharpenters will charge your method of payment at the frequency you have selected (every 3, 6 or 12 months), on the day before the envelopes are sent out. You can change your shipping address and payment method at any time by logging into your account.

Sharpenters reserves the right to refuse any order placed with the company or to discontinue its services at any time and will refund any sums collected to the extent it discontinues services before sharpening your knives or other permitted items.

  1. KNIFE ENVELOPES

The materials provided by Sharpenters as part of its service delivery, include specially developed and manufactured envelopes, knife covers, return mailing labels as well as instructions for usage of the material. These materials are adapted to fit the items being sharpened by Sharpenters and may be modified to fit the varying size of such items.

If you lose or damage any of the materials sent out by us, it should be advised to us in writing by e-mail to hello@sharpenters.com and new materials will be charged and sent at a rate of $10 per new shipment.

If the materials received are damaged, broken or seem unfit for safe mailing of sharp items in any way, DO NOT use them as this may lead to harm to you or others or loss of your items during transportation. For clarification purposes only: Damage to the materials may include holes created by forcefully packaging the knives, seals of material edges not being sufficiently tight or adhesive strips on the envelopes not properly closing the envelope.

If you suspect that any material is damaged or missing, you must contact us promptly upon receipt of such material. If you notify us thereof within fourteen (14) days from your receipt of the envelope, we will send you new material without additional charges. In case of later notification, new materials will be charged and sent at a rate of $10 per new shipment.

  1. OBLIGATIONS OF SHARPENTERS

Sharpenters shall provide packaging material as well as a professional sharpening service for retail and professional customers.

Sharpenters attempts to send back the items submitted for sharpening within five (5) business days from arrival to us. Sharpenters does not provide a guarantee or strict timeline as events outside our control may affect the time needed for sharpening and shipping. The options for shipping time provided when placing the order are estimates based on the information provided to us by our shipping partners.

Sharpenters will make one (1) attempt at sending back the sharpened items and it is the customer’s responsibility to ensure correctness of the delivery address and ability of mail carrier to access the address for delivery of the shipment. Any shipment returned as undeliverable, regardless of reason, will incur an additional shipping cost for reshipment.

  1. CUSTOMER OBLIGATIONS

Customer shall send items in accordance with the instructions included with the packaging material and provided on www.sharpenters.com. Sharpenters may modify these instructions at any time at its discretion and it is therefore important that you read the instructions every time before sending new items for sharpenting, even if you have used the service previously.

All items sent for sharpening need to be washed and completely clean. Any item that is not clean incurs a cleaning charge of $10 which shall be paid before sharpening commences. Should a Customer not make such payment within 10 business days from notification by Sharpenters to the Customer, the items sent for sharpening will be retained by Sharpenters until such payment is made and shall otherwise permanently be considered the property of Sharpenters after one year.

When purchasing the service, customer shall select the number of items for sharpening as well as (in the case of selecting a subscription service) to choose the frequency for sharpening.

You should ensure that all items sent to Sharpenters are sent in the envelopes and knife covers provided by Sharpenters only, that all items fit comfortably in the envelopes and that no other packaging material is used. This ensures safe and traceable shipment of your items. You shall always follow the instructions on cutting the knife covers to size. If Sharpenters receives items with incorrectly cut knife covers or other modification to packaging by the customer, the items will be returned in new materials (correctly sized knife covers and/or undamaged packaging) and a cost of $15 will be charged, which shall be paid before the items are returned. Should a Customer not make such payment within 10 business days from notification by Sharpenters to the Customer, the items sent for sharpening will permanently be considered the property of Sharpenters. Any deviations from packaging instructions shall only occur upon previous written approval by Sharpenters.

Upon receiving your sharpened knife, it is your responsibility to open the packaging carefully as knives are extremely sharp. Moreover you must wash each knife to ensure that it is properly clean before use.

  1. SHARPENING

Sharpenters is offering a professional sharpening service, with items being sharpened in a way that many professional chefs prefer for their knives. Knives can be sharpened through different methods. The same applies to the end result as well as the shape of the knife when returned which is also to a large degree dependent on the maintenance of the knife throughout its lifetime. By submitting your knives and other items for sharpening to us, you explicitly approve the discretion of the professional sharpeners at Sharpenters to decide how to best sharpen and shape your items before returning them to you. This applies to all items, including antique knives, collectible items, etc. No considerations will be made to other sharpening techniques than the ones used by us on a daily basis.

Sharpenters sharpens all items on rotating, air cooled sharpening belts and polishes the raw edge on a so called buffer with vegetable wax. Sharpenters does not offer whet stone sharpening of any items.

As opposed to a shaving knife, a kitchen knife should have "sharpening lines" on the blade. If knives are being sharpened on stones that are too fine in detail, the knife will be unable to grip into common food ingredients such as tomatoes, onions etc. A shaving knife is sharpened with up to 30,000 grit but is meant for a completely different usage.

The service we provide is to sharpen the edge of the blade of your items. Thus, polishing the items or trying to remove aesthetic deficiencies is not part of the service. In order to achieve a professional sharpened edge of the blade we may need to remove a greater part of the blade than you envisioned. We are unfortunately not able to provide detailed information about this in advance but will always strive to limit the part of the blade being removed. In order to limit the part of the blade being removed we may rather alter its shape and thus return your item with a different shape to what it had when you submitted it to us.

To ensure the appropriate function of your knives, the heel of all knives sent to us is reduced in equivalent measure to the rest of the blade, to ensure that all of the blade can make contact with the cutting surface as well as securing that we are able to sharpen the whole item. This alters the shape of the heel. If you do not want us to alter the heel of your knives, you must advise us thereof before submitting the items for sharpening by sending an e-mail to hello@sharpenters.com and items should only be sent to us after you have received confirmation that we have received your e-mail and are able to fulfil your request.   1. LIMITATIONS OF LIABILITY

DISCLAIMER OF WARRANTIES. WE PROVIDE THE WEBSITE, THE PRODUCTS, AND SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT REPRESENT OR WARRANT THAT THE PRODUCTS, THE WEBSITE, THE SERVICES, ITS USE, ANY INFORMATION ON IT: (I) WILL BE UNINTERRUPTED OR SECURE, (II) WILL BE FREE OF DEFECTS, INACCURACIES OR ERRORS, (III) WILL MEET YOUR REQUIREMENTS, OR (IV) WILL OPERATE IN THE CONFIGURATION OR WITH OTHER HARDWARE OR SOFTWARE YOU USE. WE MAKE NO WARRANTIES OTHER THAN THOSE MADE EXPRESSLY IN THIS TERMS OF SERVICE, AND HEREBY DISCLAIM ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT.

EXCLUSION OF DAMAGES. WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES RELATING TO LOST PROFITS, LOST DATA OR LOSS OF GOODWILL) ARISING OUT OF, RELATING TO OR CONNECTED WITH THE USE OF THE WEBSITE OR PRODUCTS/SERVICES, REGARDLESS OF THE CAUSE OF ACTION ON WHICH THEY ARE BASED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OCCURRING.

FINANCIAL LIMITATION OF LIABILITY. IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING FROM, RELATING TO, OR IN CONNECTION WITH THESE TERMS OF SERVICE (INCLUDING, WITHOUT LIMITATION, CLAIMS RELATING TO THE WEBSITE, OR THE PRODUCTS/SERVICES) EXCEED THE GREATER OF $100 OR THE AMOUNT THAT YOU PAID FOR THE PRODUCTS/SERVICES.

Sharpenters is not liable for delays or any additional costs related to arrival time of the sharpened items and we do not provide monetary compensation for delayed arrival of the items. We strongly recommend our customers to send your items for sharpening well ahead of the time which they are needed in return.

The package carrier may at their discretion choose not to deliver the items to your delivery address and instead provide a pickup option at a remote box, store or other pickup point. Sharpenters is not able to influence this and we do not offer any compensation for the effort of picking up the shipment elsewhere.

Items with visible cracks may not be sharpened but will returned unsharpened or partially sharpened. Sharpening of items with hidden cracks which may pose a risk for the sharpener due to breaking or loosening of the blade will be immediately interrupted and returned in the state they are in at the time of interruption of the sharpening. Sharpenters does not charge a fee for the sharpening of the item but no additional compensation will be provided. If items arrive with visible cracks, a significant part of the blade will be removed to eliminate the crack or a new edge will be sharpened on the blade, leaving the crack in place. The appropriate course of action for each item is solely and fully at the discretion of Sharpenters.

When extreme discoloration, oxidization or other alteration to the original state of the blade is apparent, Sharpenters will at its discretion decide on the appropriate course of action, including the option to sharpen a new edge with one or several indentations.

Sharpenters is not responsible for and does not accept liability for the full removal of sharpening wax and steel particles from items upon sharpening. Recommendations for after sharpening care of items can be found on our website www.sharpenters.com. Please be sure to thoroughly clean each knife prior to use.

No compensation is provided for scratches, blemishes or other alterations to the previous state of items while in the care of Sharpenters. When a blade is sharpened and polished, the side of the blade is also affected to a certain degree, including the polishing. Thus, previous scratches will be significantly more visible.

Sharpenters will attempt to straighten bent items, e.g. crooked blades or tips to a reasonable extent. During these efforts, the blade or the tip may break. In such situations, Sharpenters will attempt to sharpen a significantly smaller/shorter blade from the remaining part of the blade or return it in its broken state in discussion with the Customer. Sharpenters will not compensate the Customer for damage occurring as part of straightening or reparation attempts.

On rare occasions, the sharpeners of Sharpenters may accidentally create unintended alterations or damage to items, including but not limited to contact between the sharpening belt and the handle or other part of the item not meant for sharpening. Should this occur, the sharpening will be completed, and the item returned with a fully sharpened blade. As compensation for the damage to the item Sharpenters will refund the cost of its sharpening. No other compensation will be provided, in funds or in kind.

SPECIAL REQUESTS: Should you have special requests regarding the sharpening of your items, this shall be communicated via e-mail to hello@sharpenters.com before the items are submitted for sharpening. Requests must be confirmed in writing by Sharpenters to be considered received. Unless confirmation has been provided by Sharpenters, regular sharpening will be applied to the items if they are submitted. In the message, the full name and contact details including cell phone number of the Customer shall be provided, together with specifications on which item is referred to and a marking shall also be applied to the knife cover referring to the e-mail (e.g. "See e-mail with special instructions"). Notes with requests enclosed with items submitted for sharpening will not be considered.

  1. SUBSCRIPTIONS

By ordering a "Subscription", frequently denominated as the "Sharp Always" service, and agreeing to the terms on this page, you agree to accept these terms and conditions ("the Terms") for the Sharpenters subscription ordering program ("Subscription").

A Subscription is in continuous force until cancelled. Cancellations may be made under "My Account" or by e-mailing us at hello@sharpenters.com before the next charging of the registered credit card on the account, i.e. shortly before the next envelope is sent out. When e-mailing us, such notice is only considered received if confirmed in writing by Sharpenters. Cancellations made after that time will be applied to the subsequent sharpening and the current envelope will be sent out as usual. Automatic renewal of the Subscription happens at the end of each 12 month period starting from the initial purchase date of the Subscription. Sharpening envelopes will be sent by Sharpenters at the time interval chosen by the Customer when purchasing the Subscription.

At the time of order, you can select the number of sharpening occasions annually as well as the number of items to be sharpened on each occasion.

If you wish to change your Subscription to a higher/lower number of sharpenings than initially ordered, this can be done by reaching out to us via e-mail at hello@sharpenters.com before the charging of the registered credit card on the account for the next sharpening, i.e. shortly before the next envelope is sent out. Such notice is only considered received if confirmed in writing by Sharpenters. Such notice is only considered received if confirmed in writing by Sharpenters. Changed subscription frequencies will always be charged at the then current cost for subscriptions.

Envelopes with items for sharpening may be returned up to one year from the date of being sent. After such date, Sharpenters will charge a one-time sharpening fee for any envelope with items returned for sharpening, at the current rate at the time.

Sharpenters may at its discretion (and with prior written notice to you) send each envelope up to three months (90 days) earlier or later than the scheduled time for sending it out, in order to balance peaks and troughs in demand. Your credit card will not be charged until one day before the envelope is actually sent out.

Should a Customer hold, dispute or in any other way cancel a payment applying to any sharpening event after payment but before sharpening and fail to make an equivalent new payment within 10 business days from being notified thereof by Sharpenters, the items will be retained by Sharpenters until such payment is made and shall otherwise permanently be considered the property of Sharpenters after one year.

If sharpening has already been performed and if the payment was applicable to a Subscription, the Subscription will be considered cancelled by the Customer and no further envelopes will be sent until payment has been made.

  1. ONE TIME SHARPENING

The Customer may, at the time of ordering the Service choose to only receive a one-time sharpening, meaning that the Customer does not commit to a Subscription. Customers may return their envelopes for sharpening at any time within 12 months from the envelope being sent out. After the 12-month period has passed, the envelope will be considered forfeited, and items submitted for sharpening in it shall be charged a new one-time sharpening fee at the rate in force at the time.

Campaigns and discounted pricing do not apply to one time sharpening unless specifically advertised to the contrary.

  1. EXTRA SUBMISSIONS

A customer who has a Subscription may request additional submissions of items for sharpening, i.e. increase the frequency beyond the maximum regularly offered. A customer wishing to request this service will receive the same price per sharpening (assuming the number of items is the same) for the additional sharpenings as for the price per sharpening at the maximum generally available, i.e. the lowest price generally available.

Ordering and payment of extra submissions shall occur by reaching out to us at hello@sharpenters.com.

Discounted pricing received at the ordering of the Subscription shall not apply to extra submissions unless specifically advertised to the contrary.

  1. LIMITATIONS ON PROVISION OF SERVICE

Sharpenters reserves the right to not provide the Service relating to items which it in its sole discretion deems conditionally or exclusively created for use as weapons. Such items include, but are not limited to stiletto knives, swords, bayonets, butterfly knives, bowie knives, OTF (Out the Front) knives, shurikens (also known as throwing stars or ninja stars) – collectively "prohibited items". If prohibited items are sent to Sharpenters for sharpening, the items will be returned to the sender without provision of the Service. Items created for use as tools for hunting, fishing or other outdoor activities are not considered prohibited items. But if you are in doubt, please send us a photo of the item to hello@sharpenters.com for approval before submitting the items. In order to avoid possible additional costs, you should not send any such items before receiving written approval in return from Sharpenters. Sharpenters also does not sharpen genuine single beveled Japanese knives which require flat sharpening.

Sharpenters also reserves the right not to provide the Service for any item not included in the price list in force at the time of submission. A customer wishing to use the service for a non-listed item should contact Sharpenters in writing at hello@sharpenters.com to inquire about the ability to sharpen the item and the applicable cost therefore. Including a photo of the item is strongly encouraged as it allows a faster and more exact reply from our side.

**Should Sharpenters receive an item which in its discretion is included among prohibited items or is not included in the current price list at the time and Sharpenters therefore returns the item without providing the service, no refund will be provided for that sharpening as Sharpenters needs to cover its costs for transport, handling, evaluation and administration of the items.

Sharpenters does not accept hair cutting shears or ceramic knives. Such items will be returned without performance of the Service.

  1. ACCURACY OF INFORMATION.

We attempt to ensure that the information on the website is complete and accurate; however, this information may contain typographical errors, pricing errors, and other errors or inaccuracies. We assume no responsibility for such errors and omissions, and reserve the right to: (i) revoke any offer stated on the website; (ii) correct any errors, inaccuracies or omissions; and (iii) make changes to prices, content, promotions, product/service descriptions or specifications, or other information on the website.

  1. RETURNING INCORRECT ITEMS

If a Customer should receive items different from the ones submitted by the Customer for sharpening, Sharpenters shall immediately be notified by e-mail at hello@sharpenters.com. The items shall without delay, and under no circumstance later than 10 business days upon receipt, be returned to Sharpenters by certified mail. Sharpenters shall provide the Customer with the needed number of envelopes, knife covers and postage labels. The Customer accepts responsibility for keeping the certified mail receipt and providing it to Sharpenters on request.

Should the Customer not return the items on the later date of 10 business days upon receipt or 5 business days after receiving the envelopes, knife covers and postage labels for the return, Sharpenters has the right to charge the customer for the equivalent of current new purchase value of such items unlawfully being retained.

Sharpenters shall, in addition to covering costs as per above for returning the items sent in error, also return the correct items to the Customer and shall as compensation for the Customer’s assistance in returning the incorrect items refund the cost for the Customer’s own sharpening on one occasion.

  1. PRICING

The prices applicable for use of the Service are provided on the Sharpenters website, www.sharpenters.com. Discounts, when offered, apply only to the first sharpening event and are not applicable to one time sharpening unless otherwise explicitly advertised. Thus, the pricing for the second sharpening may differ from that for the first one. You are responsible for paying any applicable sales tax indicated on the website.

Sharpenters accepts no liability for lack of applicability or other loss to Customers related to discount codes provided by third parties, including discount code websites nor for incorrect or expired discount codes.

Sharpenters reserves the right to adjust its pricing at any time. Subsequent to price changes, the new price shall be applied to the next sharpening for the Customer.

  1. CAMPAIGNS

Campaign codes may only be used once per shipping address in any five-year period.

Unless specifically stated otherwise, campaign codes are only eligible for use at the first sharpening for each Customer.

Campaign codes are not eligible for one time sharpening, unless specifically advertised otherwise.

  1. CANCELLATIONS AND REFUNDS

All Subscriptions are continuously renewed until cancelled. Cancellations may be made under "My Account" or by e-mailing us at hello@sharpenters.com for the next sharpening before the next charging of the registered credit card on the account, i.e. shortly before the next envelope is sent out. Such notice is only considered received if confirmed in writing by Sharpenters. Cancellations made after that time will be applied to the subsequent sharpening and the current envelope will be sent out as usual.

Cancellations of one time sharpenings or subscriptions cannot be made before the first sendout of envelopes has occurred as the envelopes are immediately prepared and the address labels printed (and postage paid for by Sharpenters) upon receipt of the order.

Refunds as eligible under these Terms will be refunded exclusively to the form of payment used by the customer at the initial time of order or – should customer so request e.g. due to the form of payment having expired – by check to the billing address used at time of order. All requests under this paragraph must be made in writing to hello@sharpenters.com and approved by Sharpenters to be considered valid.

  1. PAYMENT

By ordering a one time sharpening service or a Subscription, you give Sharpenters the right to charge your card the price shown at checkout on either a one time or recurring basis, as applicable. If purchasing the Subscription service, you give Sharpenters the right to charge a different amount than the first time should either a campaign offer be in force for your initial purchase or a price change have occurred between the first sharpening and any subsequent one.

  1. NUMBER OF ITEMS FOR SHARPENING ORDERED

The price for sharpening (whether a Subscription or one-time) is considered a bundled purchase and includes Sharpenters’ costs for administration, printing, sharpening and transport. No refund shall be provided should the Customer send a lesser number of items for any sharpening event than what has been purchased and paid for.

Should the Customer send more or different items than what has been paid for, sharpening will not commence until full payment for the correct number of items has been made. If the customer has not made such payment within 10 business days from the receipt of the items, a lesser number of items will be sharpened and all items will be returned with some of the items unsharpened. Sharpenters reserves the right to select which items to sharpen in such a situation at its discretion.

  1. TRANSPORT

USPS Insurance for a value up to $100 per order is included with every order. In order to make a claim under the insurance at least one of the following must be provided: Proof of purchase of the items being claimed under the insurance or photo of the items prior to being placed in the Sharpenters envelope, with such envelope also shown in the photo. If you wish to purchase additional insurance, select UPS Express shipping at checkout or e-mail our support team at hello@sharpenters.com. Should any item be lost, Sharpenters will use the tracing method of the shipping carrier and only upon completion of the search by the shipping company will compensation be provided to the customer if the claim is approved by the shipping company. Insurance is provided by the shipping company and the decision of the shipping company related to all claims is final. Please note that tracing may take a long time, sometimes over 30 days.

For particularly valuable or important items, we recommend sending your items with UPS Express Shipping. When selecting UPS Express Shipping, your items are insured up to $500 by UPS. When purchasing additional insurance, if the items are lost you will be compensated the lower of actual purchase value for the items and $500. Proof of purchase showing the value when purchased is required for eligibility for compensation. Please contact us at hello@sharpenters.com before submitting any items of greater value for sharpening.

Sharpenters will always use the same mailing method, speed and insurance level as the Customer did when submitting items for sharpening.

Should the customer not purchase additional insurance at time of checkout, the maximum compensation provided will be $100, if the Insurance claim is approved by USPS.

The same terms apply if you submit your items for sharpening at our office in Naples, FL.

Should items be undeliverable for any reason (including but not limited to certified mail needing to be picked up by someone other than the original addressee or the address being incorrect or unknown) and the items are resent to Sharpenters, Sharpenters reserves the right to claim payment of additional reasonable shipping costs, printing of new labels and administration at its discretion. Should a Customer not make such payment within 10 business days from being notified thereof by Sharpenters, the items will be retained by Sharpenters until such payment is made and shall otherwise permanently be considered the property of Sharpenters after one year.

The tracking information of the shipping carrier will be considered final and binding upon both the Customer and Sharpenters, i.e. no compensation will be provided and no claim considered for missing items if the tracking information shows the items as delivered.

  1. GUARANTEE

Sharpenters guarantees your satisfaction with the sharpening service. Should you for any reason not covered by these Terms not be fully satisfied with the service performed, Sharpenters offers one (1) resharpening free of charges for transport or sharpening to the Customer. Should you wish to take advantage of this guarantee, an e-mail should be sent to hello@sharpenters.com explaining the reasons for your dissatisfaction in detail, along with a minimum of one photo supporting your claim as well as stating the fact that you wish to take advantage of the guarantee. Sharpenters will, at its sole discretion decide if the guarantee is applicable to the claim and should it consider it not to be so, will explain the reason for its decision. Should Sharpenters decide that the guarantee is applicable to your claim, a new envelope will be sent out for you to return the items in.

Any claim under the guarantee must be filed within five (5) business days from receipt of the item by the Customer. The guarantee exclusively relates to the sharpening and thus is limited to the state in which the items were received in return to the Customer.
